Terms of Use

1. Acceptance of these terms

These Terms of Use ("Terms") are a legally binding agreement between you ("you", "your", "user") and Clawtica ("we", "us", "our") governing your access to and use of the Clawtica website (the "Site") and the Clawtica service, including any software, tools, and features we provide to deploy and use OpenClaw (the "Service"). By accessing the Site or using the Service (including by creating an account, connecting a channel such as Telegram or Discord, or clicking to accept where we offer that option), you agree to be bound by these Terms. If you do not agree to these Terms, you must not access the Site or use the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms, and "you" will include that organisation.

2. Description of the service

Clawtica provides a platform that allows you to deploy and connect OpenClaw (an AI assistant) to messaging and communication channels such as Telegram, Discord, WhatsApp, Slack, and others ("Channels"). The Service may include account creation, authentication, one-click or simplified deployment flows, and access to documentation or support. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, to the extent permitted by law. We do not guarantee uninterrupted or error-free operation.

3. Eligibility and account responsibility

You must be at least 16 years old (or the age of majority in your jurisdiction, whichever is higher) and have the legal capacity to enter into these Terms to use the Service. If you are under 18, you should have your parent or guardian review and agree to these Terms. You are responsible for: (a) providing accurate and complete information when you register or use the Service; (b) maintaining the confidentiality of your account credentials; (c) all activity that occurs under your account; and (d) ensuring that your use of the Service complies with these Terms and all applicable laws. You must notify us promptly of any unauthorised access to or use of your account.

4. Acceptable use and prohibited conduct

You agree to use the Site and Service only for lawful purposes and in accordance with these Terms. You must not use the Service in any way that:

• Violates any applicable local, national, or international law or regulation.
• Infringes or misappropriates the intellectual property, privacy, or other rights of any third party.
• Involves fraud, deception, harassment, defamation, obscenity, or content that promotes violence, illegal activity, or harm to others.
• Attempts to gain unauthorised access to our or any third party's systems, networks, or data (including scraping, bypassing access controls, or probing for vulnerabilities without permission).
• Overloads, disrupts, or impairs the integrity or availability of the Service or any connected systems (e.g. denial-of-service, malware, or automated abuse).
• Uses the Service to send spam, unsolicited messages, or to distribute malware or harmful code.
• Circumvents or attempts to circumvent any usage limits, fees, or access restrictions we apply.

We may suspend or terminate your access to the Service and/or delete your account if we reasonably believe you have breached this section or these Terms. We may also report illegal activity to the relevant authorities.

5. Intellectual property

The Site and Service, including but not limited to their design, text, graphics, logos, software, and other content (excluding user content and third-party materials), are owned by or licensed to Clawtica and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Site or Service without our prior written consent, except as expressly permitted (e.g. where we make code or assets available under an open-source or other licence). "Clawtica" and related names and marks are our trademarks; you may not use them without our permission. OpenClaw and its associated projects may have their own licences; your use of OpenClaw via Clawtica is subject to those licences as well as these Terms.

6. User content and licence you grant

"User content" means any content you submit, post, or transmit through the Service (e.g. messages, prompts, or data you send via connected Channels). You retain ownership of your user content. By using the Service, you grant us a worldwide, non-exclusive, royalty-free licence to use, store, process, and transmit your user content only to the extent necessary to provide, operate, improve, and secure the Service (including to connect to Channels and to comply with law). We do not claim ownership of your user content and will not use it for marketing or unrelated purposes. You are solely responsible for your user content and you represent that you have all rights necessary to grant this licence and that your user content does not violate these Terms or any third party rights. We may remove or refuse to display user content that we believe violates these Terms or the law.

7. Third-party services and channels

The Service may integrate with or depend on third-party services (e.g. Clerk for authentication, and Channels such as Telegram, Discord, WhatsApp). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services. When you connect a Channel, you must comply with that Channel's terms and policies. We do not control how AI models (e.g. Claude, OpenAI, Grok) or Channel providers process data; you use them at your own risk.

8. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SITE AND SERVICE AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; IN SUCH CASES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU TO THAT EXTENT.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLAWTICA, ITS OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS (USD 100). THE LIMITATIONS IN THIS SECTION APPLY WHETHER THE CLAIM IS IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless Clawtica and its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site or Service; (b) your user content; (c) your violation of these Terms or any applicable law; or (d) your violation of any third party rights. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defence.

11. Termination

You may stop using the Service and close your account at any time (via account settings or by contacting us). We may suspend or terminate your access to the Service or your account at any time, with or without cause or notice, including for breach of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including Sections 5, 6 (to the extent we need to retain or process data as permitted by our Privacy Policy), 8, 9, 10, 12, and 13) will survive termination.

12. Changes to these terms

We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. If changes are material, we may notify you by email or through the Service. Your continued use of the Service after the effective date of the new Terms constitutes your acceptance of them. If you do not agree to the new Terms, you must stop using the Service. We encourage you to review these Terms periodically.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Clawtica is operated, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts. If you are in the European Union, you may also have the right to bring claims under the laws of your country of residence. Nothing in these Terms limits any mandatory consumer rights you have under the laws of your jurisdiction.

14. General

These Terms, together with our Privacy Policy and any other policies we publish that apply to the Service, constitute the entire agreement between you and Clawtica regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision does not waive that right or provision. You may not assign or transfer these Terms or your account without our consent; we may assign our rights and obligations without restriction. No agency, partnership, joint venture, or employment relationship is created between you and Clawtica by these Terms.
